1. Acceptance of These Terms
These Terms of Use (the “Terms”) govern your access to and use of the website located at modernwealthlaw.com and all associated pages, forms, and content (collectively, the “Site”), which is owned and operated by Modern Wealth Law, APLC (“Modern Wealth Law,” “the Firm,” “we,” “us,” or “our”).
By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not access or use the Site.
We may modify these Terms at any time. Changes are effective when posted. Your continued use of the Site after posting constitutes acceptance of the modified Terms.
2. The Site Does Not Provide Legal Advice
The Site and all content on it — including articles, blog posts, checklists, videos, webinars, FAQs, downloadable resources, and calculators — are provided for general informational and educational purposes only. Nothing on the Site constitutes legal, tax, financial, or investment advice, and nothing on the Site is a substitute for advice from a licensed attorney regarding your specific circumstances.
Estate planning, trust administration, and tax law vary by jurisdiction and change frequently. Content on the Site may become outdated, and we undertake no obligation to update it. Do not act or refrain from acting based on Site content without first consulting a qualified attorney licensed in your jurisdiction.
3. No Attorney-Client Relationship
Your use of the Site does not create an attorney-client relationship between you and Modern Wealth Law or any of its attorneys. This is true whether you browse the Site, read our content, submit a contact form, request a consultation, subscribe to a mailing list, attend a webinar, or exchange emails, text messages, or telephone calls with us.
An attorney-client relationship with the Firm is created only upon the execution of a written engagement agreement signed by both you and an authorized representative of the Firm, and only after the Firm has completed a conflicts check and formally accepted the engagement.
4. Communications Through the Site Are Not Confidential or Privileged
Because no attorney-client relationship exists at the time of your initial inquiry, information you transmit to us through the Site is not protected by the attorney-client privilege or the attorney work-product doctrine, and we cannot guarantee that it will be treated as confidential.
Do not send us confidential, sensitive, privileged, or time-sensitive information through the Site. In particular:
- Do not send information regarding a matter in which the Firm may already represent an adverse party. Doing so may not prevent the Firm from representing that party, and may disqualify us from representing you.
- Do not rely on the Site to meet any statute of limitations, filing deadline, court date, or other legal deadline. We do not monitor the Site continuously and do not guarantee that any submission will be received, read, or answered within any particular timeframe.
- Internet and email transmissions are not secure. You transmit information at your own risk.
5. Attorney Advertising
This Site may constitute attorney advertising under the California Rules of Professional Conduct and the rules of other jurisdictions. The attorney responsible for the content of this Site is John L. Wong, Managing Partner, Modern Wealth Law, 2600 Michelson Drive, Suite 950, Irvine, CA 92612.
Prior results do not guarantee or predict a similar outcome in any future matter. Any testimonials, endorsements, reviews, or descriptions of past engagements appearing on the Site are not a guarantee, warranty, or prediction regarding the outcome of your matter. Testimonials are individual experiences and reflect the particular facts of those matters. No representation is made that the quality of the legal services to be performed is greater than the quality of legal services performed by other lawyers.
6. Jurisdiction and Bar Admission
The Firm’s attorneys are licensed to practice law in the State of California. We do not seek to represent, and this Site is not directed to, any person in any jurisdiction where the Site would not comply with applicable laws or rules of professional conduct. The Firm does not practice law in, and this Site does not constitute solicitation in, any jurisdiction in which its attorneys are not licensed.
7. Intellectual Property
All content on the Site — including text, articles, graphics, logos, images, video, audio, page layout, design elements, document templates, and software — is the property of Modern Wealth Law or its licensors and is protected by United States copyright, trademark, and other intellectual property laws.
“Modern Wealth Law” and any associated logos are trademarks or service marks of the Firm. You may not use them without our prior written permission.
You may view, download, and print Site content solely for your own personal, non-commercial reference, provided you retain all copyright and other proprietary notices. You may not reproduce, republish, distribute, sell, license, modify, create derivative works from, frame, mirror, scrape, data-mine, or use Site content to train any machine learning or artificial intelligence model, without our express prior written consent.
8. Prohibited Conduct
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms
- Submit false, misleading, or fraudulent information, or impersonate any person or entity
- Submit a telephone number, email address, or other contact information that is not your own or that you are not authorized to provide
- Transmit any virus, malware, or other harmful code
- Attempt to gain unauthorized access to the Site, our servers, or any connected system
- Use any robot, spider, scraper, crawler, or automated means to access or collect content from the Site
- Interfere with or disrupt the operation of the Site or the servers or networks connected to it
- Harvest or collect personal information of other Site visitors
- Use the Site in any manner that could damage, disable, overburden, or impair it
9. User Submissions
Any information, comment, question, or material you submit through the Site (a “Submission”) is deemed non-confidential and non-proprietary, subject to Section 4. By making a Submission, you grant the Firm a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, and store the Submission for the purposes described in our Privacy Policy, including responding to your inquiry and performing conflicts checks.
You represent and warrant that you own or control all rights in your Submission and that it does not violate these Terms or any third party’s rights.
10. Electronic Communications, Calls, and Text Messages
By providing your telephone number, mobile telephone number, or email address and affirmatively opting in, you consent to receive telephone calls, text (SMS) messages, and emails from Modern Wealth Law as described in our Privacy Policy.
Message frequency varies. Message and data rates may apply. Reply STOP to opt out of text messages. Reply HELP for help. Consent is not a condition of any purchase or of engaging the Firm. You may revoke consent at any time by any reasonable means. Full terms are set out in Section 4 of our Privacy Policy.
You consent to receive communications from us electronically and agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
11. Third-Party Links and Content
The Site may contain links to third-party websites, tools, or resources. Those links are provided for convenience only. We do not endorse, control, or assume responsibility for the content, accuracy, privacy practices, or availability of any third-party site. Your use of any third-party site is at your own risk and subject to that site’s terms.
12. Disclaimer of Warranties
THE SITE AND ALL CONTENT ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. To the fullest extent permitted by law, Modern Wealth Law disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement.
We do not warrant that the Site will be uninterrupted, timely, secure, or error-free; that defects will be corrected; that the Site is free of viruses or other harmful components; or that any content is accurate, complete, current, or reliable.
Nothing in this Section limits any obligation the Firm owes to an actual client under an executed engagement agreement or under the California Rules of Professional Conduct.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MODERN WEALTH LAW AND ITS ATTORNEYS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SITE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this Section may not apply to you. This Section does not limit liability that cannot be limited under applicable law, and does not apply to the Firm’s professional obligations to an actual client under an executed engagement agreement.
14. Indemnification
You agree to indemnify, defend, and hold harmless Modern Wealth Law and its attorneys, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms, your misuse of the Site, or your violation of any law or third-party right.
15. Accessibility
We are committed to making the Site accessible to visitors with disabilities and strive to conform to applicable accessibility standards. If you encounter difficulty accessing any portion of the Site, please contact us at info@modernwealthlaw.com or (949) 371-5003 and we will work to provide the information you need through an alternative means.
16. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. You agree that any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of those courts.
17. Severability; No Waiver; Entire Agreement
If any provision of these Terms is held unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force. Our failure to enforce any provision is not a waiver of that provision.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Firm regarding the Site, and supersede all prior understandings on that subject. These Terms do not modify or supersede any executed engagement agreement between you and the Firm.
