1. Introduction

Modern Wealth Law APLC (“Modern Wealth Law,” “the Firm,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information through our website located at modernwealthlaw.com (the “Site”) and through the telephone, text message, and email communications we send in connection with the Site.

By using the Site or submitting information to us through the Site, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Site or submit information to us.

This Privacy Policy does not govern our handling of information you provide to us after you have engaged the Firm as a client. Client information is governed by the California Rules of Professional Conduct, the attorney-client privilege, California Business and Professions Code section 6068(e), our engagement agreement with you, and applicable law — all of which impose confidentiality obligations that are broader and stricter than this Policy.

2. Information We Collect

2.1 Information You Provide Directly

We collect personal information that you voluntarily submit to us, including:

  • Name (first and last)
  • Email address
  • Telephone number, including mobile telephone number
  • Any additional information you choose to include in a message, comment field, intake form, or communication with us

We collect this information when you complete a contact form, request a consultation, register for a seminar or webinar, subscribe to our newsletter, download a resource, or otherwise communicate with us through the Site.

Please do not send confidential or sensitive information through the Site. See Section 12 below.

2.2 Information Collected Automatically

When you visit the Site, certain information may be collected automatically by our web servers and by third-party analytics and hosting providers, including:

  • IP address and approximate general location
  • Browser type and version, operating system, and device type
  • Pages viewed, links clicked, referring and exit pages
  • Date, time, and duration of your visit

This information is collected through cookies, pixels, log files, and/or similar technologies. See Section 8.

2.3 Information We Do Not Collect Through the Site

We do not collect Social Security numbers, financial account numbers, government identification numbers, health information, or other sensitive personal information through the Site’s public forms. If such information is needed, we will request it through a secure channel after an engagement is established.

3. How We Use Your Information

We use the personal information you provide for the following purposes:

  • To respond to your inquiry, question, or consultation request
  • To call you by telephone regarding your inquiry and our legal services
  • To send you text (SMS) messages regarding your inquiry, appointment scheduling and reminders, and our legal services, where you have opted in
  • To send you emails regarding your inquiry, appointment scheduling and reminders, newsletters, educational content, seminar invitations, and information about our legal services, where you have opted in
  • To schedule, confirm, and remind you of consultations and appointments
  • To evaluate and run a conflicts check before any potential engagement
  • To improve the Site, our content, and our services
  • To comply with legal, regulatory, and professional responsibility obligations
  • To protect the rights, property, and safety of the Firm, our clients, and others

We do not use your personal information for automated decision-making or profiling that produces legal or similarly significant effects.

4. Consent to Contact — Calls, Text Messages, and Email

4.1 Opt-In Required

We contact you by telephone, text message, or marketing email only where you have affirmatively opted in by checking the applicable consent box or otherwise expressly agreeing at the point of collection. Consent is not a condition of purchasing any goods or services, and it is not a condition of engaging the Firm.

4.2 Text Messaging (SMS) Program

By providing your mobile telephone number and affirmatively opting in, you consent to receive text messages from Modern Wealth Law at that number, including messages sent using an automatic telephone dialing system or prerecorded or artificial voice technology where applicable.

  • Message frequency varies.
  • Message and data rates may apply. Your mobile carrier’s standard rates apply; carriers are not liable for delayed or undelivered messages.
  • To opt out, reply STOP to any message from us at any time. You will receive a single confirmation message and will receive no further messages unless you re-enroll.
  • For help, reply HELP or contact us using the information in Section 16.
  • You may also revoke consent by any other reasonable means, including by calling us, emailing us, or replying with words such as “unsubscribe,” “cancel,” “quit,” “end,” or “revoke.” We will honor opt-out requests promptly and in no event later than ten (10) business days after receipt.
  • You represent that you are the subscriber to, or the customary user of, the mobile number you provide, and you agree to notify us if that number is reassigned to another person.

4.3 Email

You may unsubscribe from marketing emails at any time using the “unsubscribe” link in any such email or by contacting us directly. We may still send you non-marketing, transactional emails necessary to respond to your inquiry or administer a matter.

4.4 Telephone Calls

You may ask to be placed on our internal Do Not Call list at any time by contacting us using the information in Section 16. We honor internal Do Not Call requests and maintain them indefinitely.

5. How We Share Information

We share personal information only in the limited circumstances described below.

Service providers. We share information with vendors who perform services on our behalf — including website hosting, customer relationship management, email delivery, text message delivery, appointment scheduling, analytics, and IT support. These vendors are contractually restricted from using your information for any purpose other than providing services to us.

Professional advisors. We may share information with our own attorneys, accountants, insurers, and auditors as reasonably necessary.

Legal compliance. We may disclose information where required by law, subpoena, court order, or other legal process, or where we believe in good faith that disclosure is necessary to comply with a legal obligation, enforce our rights, or protect the rights, property, or safety of any person — subject in all cases to our professional obligations of confidentiality.

Business transfer. In the event of a firm merger, dissolution, reorganization, or similar transaction, information may be transferred as part of that transaction, subject to applicable professional responsibility rules governing client files.

5.1 Mobile Information and Text Messaging Consent — No Sharing

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as customer service and message delivery providers, is permitted. All of the sharing categories described in this Section 5 exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

5.2 No Sale or Sharing of Personal Information

We do not sell your personal information, and we do not share your personal information for cross-context behavioral advertising, as those terms are defined under the California Consumer Privacy Act. We have not sold or shared personal information in the preceding twelve (12) months. We do not sell or share the personal information of consumers we know to be under sixteen (16) years of age.

6. Data Retention

We retain personal information collected through the Site for as long as reasonably necessary to fulfill the purposes described in this Policy, to comply with our legal, regulatory, and professional obligations, to resolve disputes, and to enforce our agreements. Inquiry records are generally retained for conflicts-checking purposes even where no engagement results. Client files are retained in accordance with our file retention policy and applicable California Rules of Professional Conduct.

7. Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. However, no method of transmission over the Internet and no method of electronic storage is completely secure. We cannot guarantee absolute security, and you transmit information to us at your own risk.

If we become aware of a breach of the security of a system containing your unencrypted personal information, we will notify you as required by California Civil Code section 1798.82 and other applicable law.

8. Cookies, Analytics, and Do Not Track

The Site uses cookies and similar technologies to operate the Site, remember your preferences, and understand how visitors use the Site. We use Google Analytics for these purposes. You can learn more about Google Analytics and opt out at https://tools.google.com/dlpage/gaoptout.

Most web browsers allow you to refuse or delete cookies through your browser settings. Disabling cookies may affect the functionality of the Site.

Do Not Track. Some browsers transmit “Do Not Track” signals. Because no uniform industry standard for responding to these signals has been adopted, the Site does not currently respond to Do Not Track signals. We do, however, honor recognized opt-out preference signals (such as Global Privacy Control) where legally required.

9. Third-Party Websites and Links

The Site may contain links to third-party websites, including social media platforms, review sites, and educational resources. We do not control and are not responsible for the privacy practices of those third parties. We encourage you to review the privacy policy of any website you visit.

10. Your California Privacy Rights

10.1 California Consumer Privacy Act

To the extent the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA”), applies to Modern Wealth Law, California residents have the right to:

  • Know the categories and specific pieces of personal information we have collected, the sources of that information, the purposes for collecting it, and the categories of third parties to whom we disclose it
  • Delete personal information we have collected from you, subject to statutory exceptions (including our legal, professional, and record-retention obligations)
  • Correct inaccurate personal information we maintain about you
  • Opt out of the sale or sharing of personal information (note: we do not sell or share personal information)
  • Limit the use and disclosure of sensitive personal information (note: we do not collect sensitive personal information through the Site)
  • Non-discrimination — we will not deny you services, charge you a different price, or provide a different level of service because you exercised a privacy right

Categories of personal information collected in the preceding twelve (12) months: identifiers (name, email address, telephone number, IP address); internet or other electronic network activity information (browsing and interaction data). We collect this information directly from you and automatically through the Site.

To exercise your rights, contact us using the information in Section 16. We will verify your request by matching the information you provide against the information in our records. You may designate an authorized agent to make a request on your behalf; we may require the agent to provide proof of authorization and may require you to verify your own identity directly.

10.2 Shine the Light

California Civil Code section 1798.83 permits California residents to request information regarding the disclosure of personal information to third parties for their direct marketing purposes. We do not disclose personal information to third parties for their own direct marketing purposes.

11. Children’s Privacy

The Site is not directed to children, and we do not knowingly collect personal information from anyone under the age of sixteen (16). If you believe a child has provided us with personal information, please contact us and we will delete it.

12. No Attorney-Client Relationship; No Confidentiality of Site Submissions

Submitting information through the Site does not create an attorney-client relationship between you and Modern Wealth Law. An attorney-client relationship is formed only upon execution of a written engagement agreement signed by the Firm.

Because no attorney-client relationship exists at the time of your inquiry, information you submit through the Site is not protected by the attorney-client privilege and may not be treated as confidential. Do not send confidential, privileged, or time-sensitive information through the Site. In particular, do not send information about a matter in which the Firm may already represent an adverse party, as doing so could disqualify us from representing you.

The content of the Site is provided for general informational purposes only and does not constitute legal advice. You should not act or refrain from acting on the basis of Site content without seeking advice from a licensed attorney regarding your particular circumstances.

13. Out-of-State and Out-of-Country Visitors

The Firm is located in Orange County, California, and our attorneys are licensed to practice in California. The Site is intended for visitors located in the United States. Information we collect is stored and processed in the United States. If you access the Site from outside the United States, you consent to the transfer of your information to the United States, which may have different data protection laws than your jurisdiction.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will revise the “Last Updated” date above. Material changes will be posted conspicuously on the Site. Your continued use of the Site after any change constitutes your acceptance of the revised Policy.

15. Governing Law

This Privacy Policy is governed by the laws of the State of California, without regard to its conflict of laws principles.
